Doctor’s Haste Leaves Girl’s Arm Paralyzed

Friday, December 9th, 2011

A Douglas County, Nebraska jury determined that an obstetrician with Mid-City OB-GYN of Omaha was responsible for a birth injury that left a little girl without the use of her left arm. The jury awarded the now 3-year-old Chaylee Bentzinger-Hill $1.8 million for the ripped and ruptured nerves that occurred during her June 2008 delivery.

According to Joe Cullan, the attorney for Chaylee’s parents, Dr. Ann Sijulin used a vacuum to help the infant through the birth canal. The baby’s shoulder became stuck behind her mother’s pelvic bone, and the doctor pulled down on the baby’s head to get her through, which led to severe nerve damage.

“She panicked and she pulled,” Cullan said. “What you’re never, ever supposed to do is pull downward on the baby’s head. This case shows why. Three nerves were ripped out and two nerves were ruptured in half.”

Sijulin’s attorney, Thomas Shomaker, said he and his client were “saddened by the verdict.”

“We don’t think Dr. Sijulin did anything inappropriate or we wouldn’t have tried the case,” Shomaker said.

Almost all of the money will go directly to Chaylee, with $5,000 each for the two parents.

More Premature Babies, More Brain Damage

Thursday, December 1st, 2011

Over 60,000 babies are born each year weighing less than 3.3 pounds. Modern medicine is allowing most premature babies to survive, but many will suffer some form of brain damage.

“That means that overall rates of cerebral palsy and other neurodevelopmental disabilities are on the rise,” says David Rowitch, chief of neonatology at the University of California, San Francisco.

According to Rowitch, lack of oxygen is the chief cause of brain injury in premature infants. White matter, where the “communication highways” reside, carrying messages through the brain and to the body, is damaged by oxygen deprivation.

Rowitch originally discovered the white matter damage by examining dead infants, but recently has been able to take over 250 premature babies through an MRI by using a special incubator designed to go through the scanner. This allows scientists to detect damage to white matter immediately.

Now that scientists can detect the damage, they need a way to prevent or repair it.

Though some treatments are still years away from human trials, there are some available now, including magnetic stimulation of certain areas of the brain and temporarily lowering the body temperature of the premature infants.

Newsweek Honors Cappolino Dodd Krebs LLP

Friday, November 25th, 2011

Newsweek magazine recognizes a select group of personal injury law firms nationwide each year for excellence, and this year our lawyers at Cappolino Dodd Krebs LLP were privileged with a place on the list.

Cappolino Dodd Krebs LLP feels fortunate as they are one of only three firms in Texas to gain this recognition.

“I’m both humbled and honored,” managing partner Richard A. Dodd said after Newsweek approached the firm with the recognition. “I’d like to think that it is our hard work and commitment to our clients’ needs that led to this.”

While making Newsweek’s list is gratifying, according to Dodd, what is even more important is the fact that our partners have made the lives of many ordinary working people better. “When many of our clients come to us they are hurting and frightened. They are often struggling with serious injuries and have huge medical bills, or they’ve lost a loved one in an accident and don’t know where else to turn.”

Birth Trauma Not Uncommon, Unfortunately

Monday, November 21st, 2011

Having a child born with birth trauma can be terrifying for new parents. What you had dreamed of as a joy-filled moment can become truly upsetting if something goes wrong. As long as the injury is minor, though, a doctor can usually help your child recover.

One of the most common birth injuries is a clavicle fracture. Otherwise known as the collarbone, the clavicle connects the upper part of the breastbone with the shoulder blade. Normally there are no lasting effects from this type of injury. Infants heal quickly, and strapping the arm to the chest should allow the clavicle to heal.

Nerve damage is another type of birth injury. The brachial plexus is a group of nerves that travel from the neck to the arm. When an infant’s head and arm are pulled in different directions, damage can occur to this bundle of nerves. If the damage is minor, it can be left to heal over time. If it is more severe, surgery might be necessary, and the child still may suffer weakness in one arm for life.
