		<description><![CDATA[The Food and Drug Administration (FDA) has been sued for allegedly failing to turn over documents pertaining to the use and distribution of the morning sickness drug thalidomide. Attorneys filing a birth injury lawsuit against the companies involved with the drug claim they repeatedly requested the documents, but have not received them. The lawsuit the records pertain to claims the defendants withheld evidence proving that the morning sickness drug caused birth defects. The complaint also claims that Smith Kline &#38; French (the predecessor to GlaxoSmithKline) distributed thalidomide to more than 20,000 people even though the drug never received FDA approval. 		<description><![CDATA[In an effort to raise money for an operation to help a girl with cerebral palsy, game developer Big Ideas Digital has launched a charity drive involving one of its iPhone games. Born premature, Grace Windram was diagnosed with cerebral palsy in 2006. Birth trauma left her unable to control the muscles in her legs, arms, mouth and tongue. She underwent several treatments but is still unable to walk. Her parents hoped to change that, though, by applying to an intensive physiotherapy program at the St. Louis Children’s Hospital. Grace was accepted to the program. The only difficulty now is coming up with the money to pay for it. At $68,000, the treatment is far beyond the means of her family. 		<description><![CDATA[This summer an Iowa jury awarded the family of a little girl $1.314 million for birth injuries she sustained during a poorly performed delivery. According to the Asher family, the on-call OBGYN Specialist at their daughter’s delivery should have recognized that her shoulder was stuck behind her mother’s pelvic bone. Recognizing the problem, he should have recommended a caesarian section or attempted to free the shoulder. Instead, he went ahead with the delivery, using “excessive traction” to free the child. Injuries to the left arm became apparent immediately after delivery. The mistakes during delivery resulted in the girl having permanent injuries to the brachial plexus, a network of nerves that start in the spinal cord and control movements in the shoulder, arm and hand. Started in Buffalo, New York, the program now operates in cities in New York, Pennsylvania and Ohio. A ritual is performed by Gliding Stars students each time they go on the ice. Each skater is escorted by one or two volunteers as they form a straight line in the center of the rink. Some can stand independently; some require walkers or arm braces. 		<description><![CDATA[The largest medical malpractice award in Connecticut history was awarded recently, with $58 million going to a boy with cerebral palsy. Daniel D’Attilo was born eight years ago after a delayed delivery. The case filed by his parents in 2005 asserts that Cathy D’Attilo’s amniotic fluid had dropped by half three days before his delivery. Her doctor apparently had this knowledge, yet chose to wait to perform a C-Section. The case also states that the C-Section was performed poorly. The result of Daniel’s birth injury was brain damage, leading to a diagnosis of severe cerebral palsy. Doctors say he will never be able to speak, hear or walk. He also suffers from seizures. The lawsuit claims he made two mistakes: His choice to use a vacuum delivery was, in the eyes of some, his first mistake. They say it was unnecessary given the relatively good health of the baby in utero. Six-year-old Joshua Lindley has cerebral palsy quadriplegia and speaks using a special talking machine similar to that used by Professor Steven Hawking. He is able to understand everything, but he was unable to respond until his mom got him the digital talking aid. With the machine, he can do things like tell him mom what he wants for dinner or what he wants to watch on TV, things that most people take for granted. Odin Fortner-Watrous suffers from a rare seizure disorder called West Syndrome, caused by a lack of oxygen he experienced during his first moments in the world. “He spent four minutes with no oxygen and it caused severe brain trauma, and due to the brain damage the seizures developed,” said Odin’s mother, Shayna Fortner Watrous, telling the story of his birth. The only treatment option approved in the United States for Odin’s condition, called ACTH, costs $300,000 for a five day supply.
