Allergan Settles on Botox Case

Allergan, Inc. has admitted to attempting to market and sell Botox for unapproved uses. There has been a criminal investigation into Allergan’s marketing activities for the product Botox. Prosecutors report that the marketing was aimed at increasing off label sales as a treatment for headaches, spasticity, pain and cerebral palsy.
Based on the allegations within the lawsuit, as a part of their shady marketing practices the company trained doctors how to bill for using Botox for unapproved uses and set up a Reimbursement hotline to help doctors get reimbursed for using Botox for unapproved uses.

The settlement of the investigation includes an admission of guilt by Allergan, Inc. a criminal fine of $375 million and a $225 million civil settlement to the federal government. The civil settlement resolves the allegations that Botox has induced doctors to trick the government into paying for the use of Botox for non-sanctioned uses. The company has also agree to a 5 year corporate integrity agreement with the government to ensure through independent audits and monitoring that the company is following the federal drug marketing regulations and rules.

At this time the guilty plea by Allergan is a misdemeanor, if there are similar infractions in the future it would be considered a felony and the U.S. Department of Health and Human Services would remove all of the company’s products from the market and from all government health plans. While everyone would love to see a product that could significantly reduce the problems caused by birth injuries such as cerebral palsy the safety of the patients should be of the utmost importance. This means that all drugs should be approved by the FDA and used in the method intended.

Botox For Cerebral Palsy

A new study reports that Botox may help relieve moderate to severe drooling problems in children who have cerebral palsy or other neurological problems. However essentially Botox is a poison, a derivative of botulism and the side effects of the injections have been associated with severe and fatal injuries when the injected medication spreads to other body parts.

A clinical trial was performed involving 131 children who have been diagnosed with cerebral palsy or other non-progressive neurological disorders. Botox injections caused a significant reduction in the drooling problem in just less than 50% of the test children. The effects of the shot were apparent for about 22 weeks. Getting the medication approved for use in this manner will require an FDA approval which isn’t likely considering the problems that Botox has already caused.

Botox has been approved for cosmetic use and to treat some medical conditions like crossed eyes, excessive sweating, and cervical dystonia. It is also used off label in high doses to treat the stiff and jerky movements of children with cerebral palsy.

Cerebral palsy is considered a birth defect or birth injury because it begins just before, during or immediately after birth when a baby’s brain is deprived of oxygen for some reason. In February of 2008 the FDA warned against using Botox to treat cerebral palsy after receiving reports of sudden death, breathing problems and other life threatening side effects.

Because of this warning and the fact that a drug maker has illegally promoted the medication for use in treating cerebral palsy without adequate risk warnings, there are several lawsuits pending against the maker of Botox.

Some victims of cerebral palsy have even more to worry about, say medical watchdog groups in the U.S. and Europe.

Some doctors have treated these children with Botox as a way to treat leg spasticity but, unfortunately, reports of dangerous side effects like speech disorders, breathing problems and difficulties swallowing or holding up the head — including death — have forced the Health Sciences Authority to re-evaluate the drug.

Botox is, of course, most widely known for ironing out wrinkles but it has also been used for a variety of medical purposes.

The HSA said it has always monitored drugs for negative side effects — but ever since the US Food and Drug Administration (FDA) earlier this year highlighted safety concerns over botulinum toxins, the local authority “has kept close watch on this development although we had not seen local cases.”

Recently, the European Medicines Agency noted it had recorded over 600 cases of negative effects. In February, the FDA said it was conducting a safety review of the drug.
