Australian Woman Sues Obstetrician over Her Own Birth Injury

Halina Jane Gillett, an Australian women who will be celebrating her 26th birthday this coming October, is suing Dr. Jeffrey Robinson for her current affliction of Erb’s palsy. Dr. Robinson was the obstetrician who delivered Halina over 25 years ago. Halina’s mother, Marilyn Benson-Inglis, states that she asked Dr. Robinson about a caesarean delivery because she was concerned that her child might be too large to deliver naturally. When Halina’s mother went into labor, the two choices available to deliver the child were a caesarean or use of forceps; Dr. Robinson chose to pull the baby out with forceps.

Halina now suffers Erb’s palsy, which is a paralysis of the arm caused by an injury to the upper group of the arm’s nerves. Most commonly, excessive pulling on the shoulders, especially with forceps, causes this injury. Halina requires the use of physical therapy and assistance in the home due to Erb’s palsy, and she is now asking for reparations for this birth injury, according to dailytelegraph.com. Sadly, Halina’s mother testifies that she requested the caesarean delivery, but the obstetrician replied, “I don’t know.”

The facts of this case seem to indicate that the method of delivery that the obstetrician chose, without the birth mother’s consent, continues to plague Halina and cost her money as an adult. The hearing over the matter continues in Australia.

Erb’s Palsy Leads to Girl’s Permanent Injuries, Jury Awards Family $1.3 Million

According to About Lawsuits, an jury has awarded Alan and Larysa Asher $1.3 million after the couple filed a birth injury lawsuit against the doctor who delivered their daughter. The couple claimed the doctor failed to diagnose that her shoulders were stuck during delivery, resulting in a brachial plexus injury.

Alan and Larysa Asher filed a complaint against Dr. Anthony Onuigbo, alleging that negligence after the doctor failed to recognize that their daughter’s shoulder was lodge in place during delivery, resulting in permanent injuries when he used excessive traction to deliver her. Brachial plexus injury, also known as shoulder dystocia or Erb’s palsy, can occur when an infant becomes stuck in the birth canals and the nerves in the infant’s shoulder become damaged. Sometimes the damage occurs from pressure while being stuck or due to the doctor using too much force during delivery.

As a result of a brachial plexus injury, an infant diagnosed with Erb’s palsy can suffer permanent injuries and limited use of their arm. Asher’s daughter was born in 2006 and now has limited use of her left arm, requiring physical therapy to prevent her condition from worsening. Jury awarded the couple $1.314 million overall, including $550,000 for lost future earnings, $380,000 for the daughter’s permanent injuries, $258,000 for pain and suffering and $126,000 to the parents for loss of childhood consortium.

Shoulder Dystocia

          Shoulder Dystocia describes a situation where the baby’s head has been delivered, but the shoulders are stuck behind the mother’s pelvic bone and cannot be freed.
