Jail Neglects Woman Giving Birth

Most women who file for medical negligence due to a birth injury or other birthing problem bring their suit against a hospital or other medical professional. Imka Pope, however, brings her medical negligence suit against the King County Jail, which allowed Pope to give birth alone, on the jail floor, 14 years ago. According to SeattlePi.com, Pope suffers from schizoaffective disorder. During a psychotic episode when she was off her medication, Pope fell asleep on a Metro bus bench. Police arrested the nine-months-pregnant Pope for trespassing, and six days later, she gave birth.

Documents show that only one person on staff in the jail noted that Pope appeared pregnant, and her lawyers state that officers and nurses made little effort to treat her schizoaffective disorder. Pope alleges that on the day she gave birth, she asked for help from the guards. However, guards decided that she was not in imminent danger and left. The guards returned to her only when they heard the cry of her newborn baby.

The lawyers for King County Jail state that Pope did not suffer any injuries and that her delivery was not complicated. Pope states that the baby has a severe heart defect and that he suffered neurological damage due to a lack of immediate medical care. No child should have to suffer the continual effects of birth injuries due to medical negligence.

Court Clears Doctor of Negligence

After almost eight days of deliberation the jury in a complicated multimillion dollar lawsuit returned with the verdict that Dr. Sam Olupona is not to blame for complications in the birth of a little boy that led to severe brain injuries.

The parents of the boy filed suit against the hospital, Dr. Olupona and two hospital nurses claiming that when the mother was in labor with twins the doctor and nurses failed to monitor the babies heart rates, and did not ensure that the mother had an epidural in case of an emergency cesarean section and failed to make sure that an operating room was ready in case it was needed.
When a mother is carrying twins each of these things are considered to be routine, however it was found that Dr. Olupona did everything in his power to ensure a safe delivery of both babies and that the nurses were not involved in the delivery after the mother entered the operating room.

Of the defendants listed only one nurse was found to be negligent and failing to meet a reasonable standard of care, and of failing to follow the doctor’s orders concerning placing an epidural. While the nurse was found to be 75% to blame for the birth defects the hospital was found to be 25% percent responsible for failing to provide a nurse that would follow procedures and perform her job properly.
The damages and expenses in this case awarded to the parents of the child come to around $10 Million. The child will require lifelong constant care and will incur large medical bills due to the chain of events which left him permanently damaged.

Judgment Against New York Hospital in Medical Malpractice Case

          Strong Memorial Hospital in New York was recently ordered to pay $17 million in a medical malpractice lawsuit. The plaintiff claims that poor planning caused doctors to make costly mistakes while delivering her baby.
          During her c-section, doctors cut the connection between her bladder and transplanted pancreas, causing urine and pancreatic fluid to flow freely in her abdomen. The pancreatic fluid burned her organs, ate through her abdominal wall, and caused doctors to remove her pancreas.

Entrusting Your Child's Life in the Hands of Another

Recently I saw a picture of a couple throwing a baby out the window of their apartment, during a  fire, in an attempt to save him. You could see the smoke around the couple coming out of the window. The photograph showed the baby in mid flight against the building’s wall. What you could not see were the people on the ground without a net, waiting to catch him in their arms. I was horrified!! Why would anyone take such a risk with their baby’s life?   Then, like an epiphany, I realized that a parent would do anything, risk everything to make sure that their child is safe and well, no matter what. That family made the heart breaking decision to put their trust in the individuals on the ground and thus ensure their baby’s life.

Then I thought of all the mothers with their unborn children who every day put their lives and trust in the hands of a doctor.   Most of the time this trust is justified and sacred, but for some,   for whatever the reason, that trust is violated. In the blink of an eye their child is no longer safe and well. Their whole life and future has been forever and perhaps irreparably changed and they are looking at a life full of physical, mental & economic hardship. They need to make a decision and put their trust on other individuals to make sure that their life and their child’s life is the best that it can be.
